In October 2023 Bautista LeRoy secured a confidential settlement for the family of a woman who died of neglect after being admitted to a skilled nursing facility for rehabilitation from a broken hip. 

Our client's relative was admitted to a nursing home after she fell at home and broke her hip.  She lived independently prior to her injury and was admitted to the nursing home for physical therapy and rehabilitation with the expectation she would return home.  Thirty-three days later she was transferred to a local hospital with an infection that had progressed to sepsis.  Unfortunately, she passed away less than a day later. 

The resident's family retained Bautista LeRoy to investigate her sudden and unexpected death.  We conducted a pre-suit investigation and consulted with medical and nursing experts who confirmed the resident died of neglect.  We then filed suit and began discovery into the nursing home's policies and staffing.  Bautista LeRoy's efforts revealed that facility staff providing care for the resident had violated multiple facility policies in their care of the resident including failing to monitor her weight and failure to report significant changes in her condition to a physician.  We then proceeded with depositions of management employees who confirmed under oath there had been neglect in the care of the resident.  Finally, we secured detailed staffing information revealing that the facility was prioritizing profits over resident safety by staffing at rates far less than national and state averages.

After developing this indisputable evidence establishing that the resident's death was caused by the neglect of the facility, the party's engaged in a full day of mediation.  At the conclusion of the mediation, a confidential settlement was reached between the parties.  While this compensation will never bring back a lost loved one, it secured Bautista LeRoy's client some measure of justice and held the facility accountable for its gross neglect.
